These Terms and Conditions ("Terms") govern your use of the Get Nudged service ("Service") operated by Nina Technology LLC ("we", "us", "our"), accessible at getnudged.ai. By accessing or using the Service, you agree to be bound by these Terms.
1. Service Description
Get Nudged is an AI-powered reminder service that delivers phone calls and SMS messages to help you remember tasks, medications, appointments, and other commitments. The Service includes a web application, AI-generated phone calls, and text message notifications.
2. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Account Registration
To use certain features, you may need to provide your email address and phone number. You agree to provide accurate, current, and complete information. You are responsible for maintaining the security of your account and for all activities that occur under it.
4. Phone Calls and SMS Messages
By providing your phone number and using the Service, you expressly consent to receive:
- AI-generated reminder phone calls at times you configure.
- SMS messages related to your reminders, account updates, missed-call follow-ups, and service notifications.
- Waitlist and launch-related communications if you have joined the waitlist.
Message frequency varies based on the number of reminders you configure. Message and data rates may apply depending on your carrier plan.
Opt-out: You may stop receiving SMS messages at any time by replying STOP to any message. Reply HELP for assistance. Note that opting out of SMS does not cancel your account or phone call reminders; to cancel all communications, you must delete your account.
Supported carriers: The Service works with major US carriers. Carriers are not liable for delayed or undelivered messages.
5. Pricing and Payments
The Service offers the following tiers:
- Free: Up to 3 reminder calls per day.
- Pro ($8/month): Unlimited calls, nagging mode, and daily summary.
- Pro+ ($15/month): Everything in Pro, plus smart timing and accountability partner features.
Pricing is subject to change. We will notify you in advance of any price changes affecting your subscription. Early access waitlist members may be eligible for promotional pricing as advertised at the time of signup.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Provide false or misleading information during registration.
- Attempt to gain unauthorized access to the Service or its systems.
- Use the Service to harass, spam, or harm others.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Resell or redistribute the Service without our written consent.
7. Intellectual Property
All content, features, and functionality of the Service — including text, graphics, logos, and software — are owned by Nina Technology LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that:
- The Service will be uninterrupted, timely, or error-free.
- Reminder calls or messages will be delivered at the exact specified time.
- The Service will meet your specific requirements.
Get Nudged is a reminder tool, not a medical device. It should not be relied upon as the sole method for critical health-related reminders such as medication. Always consult your healthcare provider for medical advice.
9. Limitation of Liability
To the maximum extent permitted by law, Nina Technology LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to missed reminders, missed appointments, or any damages resulting from reliance on the Service.
Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us at support@getnudged.ai. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Delaware.
